For many LBGTQ+ couples in Italy, the US has been the path to becoming a parent through surrogacy for decades. But why now? Well, this couple could be among the first Italians prosecuted under a new ban on domestic surrogacy, which has been extended as an outright ban on domestic surrogacy and procreative tourism making it a universal crime that transcends borders, putting them on a par with terrorists and war criminals. The law includes prison terms of up to two years, as well as hefty fines.
The couple, who wish to remain anonymous, have hired Gianni Baldini, an Italian attorney, to make certain that their case gained public attention. She argues that although their son was conceived before the law was enacted, they can still be prosecuted once they return home. She did opine that the law was partially founded with the aim of protecting poor women around the world who are exploited, but she said that is not possible because surrogacy is legal in California and the majority of the US.
