Michigan has finally joined the other states, such as California, Texas and Oregon, in making compensated – traditional and gestational – surrogacy legal. For everyone in Michigan who has wanted to be a Surrogate or Intended Parent, they are finally allowed to move forward in their state without the threat of civil and criminal penalties. The change occurred when the Assisted Reproduction and Surrogacy Parentage Act, also called the Family Protection Act, was signed into law in 2024.
Previously, Michigan was the only state with both a criminal and civil ban on surrogacy, making any agreements unenforceable. These restrictions began with the 1986 case of Baby M, a case involving MaryBeth Whitehead, a traditional surrogate, who attempted to get custody from her Intended Parents.
