Texas and Surrogacy

Texas Surrogacy and Texas Surrogacy Laws

Are you confused about where to start when it comes to Texas Surrogacy? Of course, everyone is, especially with the patchwork of laws in all 50 states.  But don’t worry; with the right information and counsel, you can start your journey in the best possible position while ensuring everyone is protected – the Intended Parents, the Surrogate, and the Child.

UPDATE: Here is a link to a Texas attorney who has broken down the new Texas Law.
“The new laws do not apply to anyone providing or assisting an abortion outside of Texas.”

For example, many believe California, Illinois, Nevada, or Colorado are the best states to have a child born via surrogacy.  Why is that?  Well, because the laws in these states are known as being very surrogate-friendly, most believe that they provide a legal structure that is clear and concise.

Despite these assumed advantages, these states can make the process much more expensive.  These additional costs include the cost of living for your surrogate, the cost of medical care, the cost of IVF, and the overall cost of surrogacy itself, including agency fees and legal expenses.

When looking for other options and less expenses, many overlook Texas by assuming that the laws would be more restrictive or unclear. Yet, Texas has already established a favorable legal framework for surrogacy, making it a supportive environment for Intended Parents and Surrogates alike. In fact, Texas Family Code Sections 160-751 to Sections 160-763 explicitly recognize gestational surrogacy agreements, providing legal protection for all parties involved.

To be sure, many people have vocalized their reluctance in the media to utilize Texas Surrogacy because of all the controversy surrounding the Texas abortion law that was recently signed into law by Texas Governor Abbott.  Yet, unbeknownst to most, this law has no effect on surrogacy in the State of Texas, and Texas is and remains one of the best destinations for surrogacy without the added concerns that many people have suggested.

Texas also has a large and diverse population. This means there is a higher likelihood of finding a surrogate who matches specific preferences or requirements, and a larger pool of potential surrogates in Texas increases the chances of finding the right match.

Furthermore, Texas allows intended parents to obtain pre-birth orders, which establish their legal parentage before the birth of the child. This legal document ensures that the Intended Parents are recognized as the legal parents from the moment of birth, and the Surrogate has no parental rights or responsibilities.

It should be noted that Texas does have marital requirements for a couple seeking a pre-birth order, but these requirements can be overcome by working with an experienced legal counsel.  Counsel for the Intended Parents and counsel for the Surrogate can help navigate these particulars, as well as any concerns regarding the Texas law on abortion and selective reduction, to ensure that the journey goes as smoothly as possible for everyone.

Finally, the State of Texas is home to several world-class medical facilities and fertility clinics renowned for their expertise in reproductive medicine. These institutions offer state-of-the-art technologies and advanced treatments, ensuring that the Intended Parents, the Surrogate, and the Child receive exceptional medical care throughout the surrogacy journey.  These clinics and facilities also provide excellent care at a lower cost than most clinics and hospitals located in many other states, such as California.
