Egg Donors & ASRM Reach a Settlement in Class Action Price Fixing Case

On January 29, 2016, and after four years of litigation, the class of egg donors who challenged the American Society for Reproductive Medicine for placing a price cap on the amount of compensation donors can receive have reached a settlement.

According to Top Class Actions,

According to the terms of the egg donor class action settlement, the ASRM will eliminate wording that restricts the financial award for those who supply human eggs for reproductive services. At issue, the language that reads “[t]otal payments to donors in excess of $5,000 require justification and sums above $10,000 are not appropriate,” will be removed.

In addition, the egg donor class action lawsuit settlement states that the ASRM has agreed to not recommend any specific dollar amount regarding donor compensation in the future.

While the egg donor price-fixing class action settlement does not provide Class Members with monetary relief, those who want to file an individual lawsuit to recover past damages are able to do so under the agreement.

Surrogacy Amongst Friends – A Cautionary Tale

Many couples and individuals will often look to friends and family when discovering that they will need a surrogate to create their family. But, is this the most prudent option? Is that money savings worth your friendship? Is the savings worth your familial relationships? One woman says no.

“Jillian” just had a birthday. Her surrogate mother, Laurie B. Miller of Bridgewater Mass., keeps track on the Facebook sidelines in secret. Nearly 19 years ago, giving birth to Jillian was a loving gesture by Miller to “Meg,” her best friend. Then things went horribly wrong. Miller offers a cautionary tale about gestational surrogacy between close friends.

It was an IVF pregnancy using Meg’s eggs and sperm from Meg’s husband, “Patrick.” The tragic rift was not caused by any attachment to the child, and Miller said, “I don’t look at Jillian as my long lost child. She was never my child. I was just her suitcase.”

Instead, expectations and disappointment ended their friendship, and the two women never saw it coming.

Many people do not want to cross over into the business relationship involved in most surrogacy relationships; however, what about outside influences, including “Meg’s husband,” who may seem to some as being a bully – but, in fact, was he just protecting his wife’s feelings? Possible? But, this arrangement clearly needed more communication, and likely the help of an interested psychologist who could have helped them navigate these issues before and after the pregnancy.

As Miller stated in her book, My Body, Their Baby, “Miller has no regrets about bearing a child for her best friend. If she could, she’d do it again, but knowing one point would have made a huge difference: People do not think alike and emotions can never be predicted, which is why Conceptual Options’ Psychological Program is so important for all of the parties involved in a surrogacy.

Congratulations to Tyra Banks on the Birth of her Son via Surrogacy

Congratulations are in order for Tyra Banks and her boyfriend Erik Asla, on the birth of their son via surrogate this week! The supermodel shared her incredible news with the world late Wednesday night on her Instagram account saying,

“The best present we worked and prayed so hard for is finally here. He’s got my fingers and big eyes and his daddy Erik’s mouth and chin. As we thank the angel of a woman that carried our miracle baby boy for us, we pray for everyone who struggles to reach this joyous milestone. York Banks Asla, welcome to the world.”

Tyra has been vocal about fertility issues since she commented on infertility with her Fab Life co-host Chrissy Tiegen in September of 2015. On the show the supermodel teared up when she said that people should not ask women why they have not had children because people do not know what others are going through in private.
